Terms And Conditions
'You' includes the plural where a group booking is being made.
'Your' includes the plural where group bookings are being made.
'Service' means the service detailed here.
1. The Process
1.1 Read these terms and conditions.
1.2 Read the disclaimer.
1.3 Proceed to the booking procedure where using the online order form. If you wish to book over the telephone then call our booking line on 0800 121 6242 where our staff will assist you in your booking.
1.3.1 Read the data protection policy.
1.3.2 Fill in your e-mail address and contact details where indicated on the online order form.
1.3.3 Fill in your credit/debit card details where indicated on the online order form.
1.3.4 You will only be able to submit your order on the online order form by accepting these terms and conditions, the data protection policy and the online general form of disclaimer.
2. The contract between us
2.1 We must receive payment of the whole of the price for the Service that you order before your order can be accepted.
2.2 Once payment has been received by us we will confirm that your booking order has been accepted by sending an e-mail to you at the e-mail address you provide in your online order form. The e-mail will contain a reference number which you must bring with you on the day you have booked the Service.
2.3 Our acceptance of your order brings into existence a legally binding contract between us.
2.4 You are required to act responsibly and courteously at all times and to respect other participants. Oakfire shall be entitled to prevent any person from undertaking or completing activities in the event of unsuitable behaviour by a participant.
2.5 Oakfire reserves the right to make changes to the activities format.
2.6 Oakfire reserves the right to refuse admittance to the activities or to remove a participant from the activities should it deem necessary to do so. This includes a participant who does not comply with the safety rules and advice and the safety system or who is deemed to be under the influence of alcohol or drugs.
2.7 Participants must be dressed appropriately (see clause 2.8) and Oakfire reserves the right to refuse admittance to the activities by any participant who is not appropriately dressed.
2.8 Oakfire advises participants to wear clothing appropriate for the weather conditions and which they do not mind being damaged. In particular the following restrictions will apply: Participants may not undertake the activities in sandals or unlaced shoes, participants will be walking along country paths and lanes so wear something you don’t mind getting dirty, have good grip and support your ankles (training shoes or walking boots are advised), long hair must be tied back, scarves are not permitted to be worn, jewellery and body piercings must be removed or taped over. Oakfire will not be responsible for any damage to or loss of clothing or other personal items of persons resulting from participation in the activities.
2.9 It is your responsibility to arrive at the Oakfire site at the specified date and time. The directions suggested, are only intended as a guide. The customer must be present at the site address at the correct date and time, using their own navigation roughly 15minutes before the event start. Failure to do so can result in your booking being invalidated.
2.10 The business judgment of customer weight/height/age (or any other restriction) is final and may be decided upon by Oakfire staff on the day of the activity. If you suffer from any other conditions and are in doubt of your participation please contact Oakfire.
3. Price and Payment
3.1 The prices payable for the Service that you order is as set out in our website.
3.2 Payment shall be by credit/debit card the details of which you shall provide. During the order process, your details for processing the deposit will be kept securely. Your bank details will not be kept after the date of your activity.
3.3 Payment shall be in pound sterling and shall be inclusive of taxes.
A deposit is required within 10 days of any scheduled adventure to confirm your booking. If no deposit is received after seven days of the provisional enquiry it may be removed for preference to other customers.
3.4 We accept all major credit cards and of course, cash. We only accept company cheques if they have cleared before the date for confirmation. Cheques should be made payable to Oakfire Adventures, 227 Glenshane Road, Derry-Londonderry BT47 3EW.
3.5 We do accept euro’s, but the rate provided are approximate and sourced from (http://www.xe.com/ucc/) on a weekly basis. Prices can also vary according to your own bank rate which is your responsibility to find out.
4. Right for you to cancel your contract
4.1 You may cancel your contract with us for the Service by e-mailing us at firstname.lastname@example.org or by ringing the booking number 0800 121 6242, at least 48 hours before the date of your booked time as contained in our confirmation e-mail to you. You do not need to give us any reason for cancelling your contract, but there will be a 10% handling charge.
4.2 Once you have notified us that you are cancelling your contract, the sum debited to us from your credit card, less the 10% handling charge will be refunded to you by cheque as soon as possible and in any event within 30 days of us receiving your cancellation notice.
4.3 Should you cancel within 48 hours of the time booked we will not be obliged to refund any monies to you or provide any form of compensation to you.
5. Cancellation by us
5.1 We reserve the right to cancel the contract between us if:
5.1.1 we have insufficient numbers for the Service which renders the provision unworkable;
5.1.2 the Service you ordered was listed at an incorrect price due to a typographical error.
5.1.3 there are any events outside our control that occur and which would make the provision of the Service unworkable.
5.1.4 you are under the influence of any intoxicating substance which would in our sole opinion mean that you would be at risk or put others at risk. No refund or compensation shall be paid in such instances.
5.1.5 our safety instructors consider that you are not capable to participate in the Service you requested for whatever reason. No refund or compensation shall be paid in such circumstances.
5.1.6 having acknowledged the online General Form of Disclaimer on the website you do not sign the hard copy of the General Form of Disclaimer on your arrival. In such an instance we will not be obligated to re-credit to your account the sum deducted by us from you.
5.2 If we do cancel your contract we will notify you by e-mail and subject to clauses 5.1.4 and 5.1.5 will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
6.1 We shall have no liability to you for any error or omission within the confirmation e-mail. It is your responsibility to notify us by e-mail at email@example.com / firstname.lastname@example.org or by calling our booking number 0800 121 6242 and providing us with any necessary details or amendments. Our only obligation will be to make good any error or omission.
6.2 We shall use reasonable efforts to ensure that the Service starts at the prescribed time in the confirmation e-mail. However, it is your responsibility to arrive to the destination in good time.
6.3 We may decide at our discretion whether any late arrivals may participate in the Service having particular regard to any necessary safety training. No refund or compensation shall be given in such instances.
6.4 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses howsoever arising in relation to the provision of the Service and we shall have no liability to pay any money to you by way of compensation.
6.5 It shall be your responsibility to ensure that you wear sensible clothing having regard to the Service you are ordering and any weather conditions that may occur from time to time. We shall not accept any liability for injury, loss or damage as a result of your negligence under this clause.
6.6 It is your responsibility to ensure that you are compliant with any age/height/weight restrictions that are in force for the relevant parts of the Service that you are ordering. Persons who are under the prescribed age/height/weight shall not be able to participate in that part of the Service and in this instance no refund shall be made by Oakfire Adventures.
6.7 We are providing this site on an 'as is' basis and make no representations or warranties of any kind with respect to this site or its contents and disclaim all such representations and warranties. In addition, we makes no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics published in this site. The information contained in this site may contain technical inaccuracies or typographical errors. All liability howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
6.8 Neither we nor any of our directors, employees or other representatives will be liable for loss or damage arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
6.9 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
All participants need to sign or have parental / guardian consent before taking part in any of Oakfire Adventures activities.
18 years or over (defintion: adult) can sign for themselves.
16 & 17 year olds (defintion: teen) must have parental / guardian consent and are allowed access unto the site unaccompanied.
15 year olds & unders (defintion: minor) must have parental / guardian consent and need to be accompanied by someone 18 or over, a maximum of 10 minors per adult.
By participating in the Service you acknowledge that there are risks to your safety and that you participate at your own risk.
You must accept all the policies, terms & conditions on this website before your arrival, each participant must sign their age specific hard copy of the disclaimer suitable to them.
We would advise you to print off the disclaimer suitable for you and provide any users of the Service for whom you are making this booking with a copy in order that they are aware of the disclaimer which is applicable to them.
You accept and understand that should any party to the booking fail to sign a hard copy of disclaimer or does not have the suitable consent on arrival they will not be permitted to participate and no refund will be available.
If we consider a participant to be underaged and not suitable to take part they will be denied access, if appropraite photographic documentation is presented we will reconsider the matter, our decision is final.
8. Intellectual Property
We are the proprietor of the Oakfire Adventures mark. All other trade marks, brand names, product names and titles and copyrights used in this site are trade marks, brand names, product names or copyrights of their respective holders. No permission is given by us in respect of the use of any of them and such use may constitute an infringement of the holder's rights.
9. Our duty to you
9.1 All necessary safety instruction shall be provided by qualified safety instructors.
9.2 All necessary safety equipment shall be provided by us, such equipment shall be checked by the safety instructor before allocation to you.
Unless otherwise expressly stated in these 'terms and condition's all notices from you to us must be in writing and sent to Oakfire Adventures, 227 Glenshane Road, Derry-Londonderry BT47 3EW and all notices from us to you will be displayed on our website from time to time.
11. Events beyond our control
11.1 We shall have no liability to you for any failure to carry out the Service you have ordered or any delay in doing so that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, accident or unsafe weather conditions.
11.2 Should the Service be cancelled in this instance we shall make all reasonable endeavours to rebook you at a later date.
11.3 Should you be unable to agree to a rebooking at a later date we shall re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
You acknowledge and agree to be bound by the terms of our data protection policy .
14. Third party rights
Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
15. Governing law
The contract between us shall be governed by and interpreted in accordance with UK law and the UK courts shall have jurisdiction to resolve any disputes between us.
The customer cannot participate at Oakfire Adventures if they are:
Suffering from migraines / headaches or have ever had whiplash
Suffering from high blood pressure, any heart condition or epilepsy
Suffering from, or have ever had, any back or neck problems
Have ever had any broken bones
Under the influence of alcohol or drugs
Undergoing medical treatment or have had an operation within the past twelve months
H2OGO: less than 6 years old
H2OGO: 1 to 3 participants combined weight not exceeding 250KG
Harness OGO: under 1.5metres / 5ft
Harness OGO: less than 8 years old
Harness OGO: exceeding 90kg
Swing: under 10 years old
Swing: minimum height 1.50m (5ft)
Swing: maximum weight 140kg (22 stone)
The size of our harnesses dictates the size of the participants that we can safely allow to take part on our activities. The maximum waist measurement of the harness is 110cm (43 inches) and the leg loops (which go around the top of your thighs) measure 70 cm (27 inches). If your measurements are close to or exceed these figures there is a possibility you may not fit in a harness and therefore will not be able to participate. We have various harnesses for different activities and it maybe a case of just trying it on for size.
17. Entire agreement
These terms and conditions, together with our current website prices, confirmation e-mail, general form of disclaimer, contact details and data protection policy, set out the whole of our agreement relating to the supply of the Service to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any services offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall not incur liability for any such representation being untrue or misleading. Any typographical, clerical or other error or omission in any booking confirmation or other documentation issued by Oakfire (including any electronic documentation) shall be subject to correction without any liability on the part of Oakfire.
18. Intellectual property rights
Unless otherwise stated Oakfire owns the intellectual property rights and material in the website, you may view and download for caching purposes only.
